This privacy policy governs your use of a software application (“Application”) on a mobile device that was created by Blobbyfish LLC (“Company”, “We”, or “Us”). The Application is an “endless jumper” game that allows the user to traverse the skyline of a city. The user can collect bonus coins and funnel cakes through use of the Application. These coins and cakes can be used to collect new heroes and accessories through the in-game shop. The Application also includes a link to FGTeeV’s YouTube channel to watch videos from the inspiration of the Application. 


While this policy discusses data that We share with our third-party advertising partners, this policy does not govern the data that is collected by those third parties. Those third parties have their own privacy policies that govern the data that they collect, and We encourage the user to review those policies before using the Application.


Additionally, as mentioned above, the user may access websites through this Application. This policy does not govern the information collected through any websites that the user can access through the Application.

Please read this policy carefully to understand our policies and practices regarding your information and how We will treat it. If you do not agree with our policies and practices, do not download, register with, or use the Application. By downloading, registering with, or using the Application, you agree to this privacy policy. This policy may change from time to time (see Changes to this Privacy Policy). Your continued use of this App after We revise this policy means you accept those changes, so please check the policy periodically for updates.


User Provided Information

The Application obtains the information you provide when you download and register the Application. No additional user-provided information is required unless the user requests an in-game purchase. Purchasing items in game requires the user to provide credit card information and billing details to the relevant application store. We record the fact that the user has made a purchase, including which purchase was made, to ensure that the purchase is properly applied to the user’s account. Finally, We will keep records and copies of your correspondence, including email addresses and phone numbers, if you decide to contact Us. The basis for processing the information described in this Section is to perform the contract with you related to these activities and services, or because you have asked us to take specific steps before entering into a contract in respect to these activities and services.


Automatically Collected Information

The Application may collect certain information automatically, such as the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application. When you access and use the App, We may automatically collect certain details of your access to and use of the App, including traffic data, logs, and other communication data, and the resources that you access and use on or through the App. 


This Application collects information about the location of your device. To serve you with relevant advertisements, the Application uses data from your GPS and WiFi to determine your location, which is shared with our third-party advertising partners to serve you with advertisements that are directly relevant to you. See the sections titled “Automatic Data Collection and Advertising” and “What third-parties collect my information” for examples of what We collect and how We protect this data.


We may use the information We collect to display advertisements to our advertisers' target audiences. Even though We do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria. We have a legitimate interest in processing the information described in this Section for the administration of our business and the provision of our services.


Do third parties see and/or have access to information obtained by the Application?

Yes. We will share your information with third parties only in the ways that are described in this privacy statement. We may disclose User Provided and Automatically Collected Information:


  • as required by law, such as to comply with a subpoena, or similar legal process;
  • when We believe in good faith that disclosure is necessary to protect our rights;
  • to protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • to our subsidiaries and affiliates when relevant and reasonably necessary;
  • to fulfill the purpose for which you provided the information;
  • for any other purpose disclosed by Us when you provided the information;
  • with our trusted services providers who work on our behalf, do not have an independent use of the information We disclose to them, and have agreed to adhere to the rules set forth in this privacy statement;
  • if Blobbyfish LLC is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via a prominent notice on our web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information;
  • to advertisers and third party advertising networks and analytics companies as described below under the Section entitled Automatic Data Collection and Advertising; or
  • when We have your consent.


What third-parties collect my information?

When you use the Application or its content, We allow certain third parties to use information collection technologies to collect information about you or your device. These third parties may use tracking technologies to collect information about you when you use the Application. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based advertising or other targeted content. The third parties We use include:

Analytics and Application Support:

  • Unity Analytics by Unity Technology – We use this company to provide Us with analytics information about how our users are interacting with the Application.   • Playfab by Microsoft – We use this company to implement user purchases in game. We do not share any more information with this company than is reasonably necessary to effectuate that result.


Advertisers and Advertisement Networks:

  • AdMob by Google – We use this company to serve you with targeted advertisements that are directly relevant to you. For more information about the types of data that AdMob collects and how it is used, please visit: https://policies.google.com/technologies/partner-sites.
  • Unity Ads by Unity Technology – We also use this company to serve you with targeted advertisements that are directly relevant to you. We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. For information about how you can opt out of receiving targeted advertising from many providers, see the section titled “What are my opt-out rights for targeted advertisements?” below.


Automatic Data Collection and Advertising

This Application is supported via advertising and collects data to help the Application serve advertisements. As described above, We may work with analytics companies to help Us understand how the Application is being used, such as the frequency and duration of usage. We work with advertisers and third-party advertising networks, who need to know how you interact with advertising provided in the Application which helps Us keep the cost of the Application free. Advertisers and advertising networks use some of the information collected by the Application, including the unique identification ID of your mobile device. These third parties may also obtain information about other applications you’ve downloaded to your mobile device, the mobile websites you visit, your location information (e.g., your zip code), and other location information in order to help analyze and serve anonymous targeted advertising on the Application and elsewhere. We may also share encrypted versions of information you have provided in order to enable our partners to append other available information about you for analysis or advertising related use. What are my opt-out rights for targeted advertisements?

There are multiple targeted advertisement opt-out options for users of this Application:


  • Opt-out of all information collection by uninstalling the Application – You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.
  • Opt-out from the use of information to serve targeted advertising by advertisers and/or third party network advertisers – 
  • Android: 
  • Find Google Settings in one of these places (depending on your device): 
  • A separate app called Google Settings. 
  • In your main Settings app, scroll down and tap Google.
  • Tap Ads.
  • Switch on Opt out of interest-based ads.
  • iOS
  • Tap on Settings, then Privacy, then Advertising 
  • Tap on Limit Ad Tracking.
  • Third-party alternative: the Digital Advertising Alliance offers an application called the AppChoices app. Through this application, the user is able to limit the collection of cross-app data for interest-based advertisements. It is available at: https://youradchoices.com/appchoices.
  • NAI - We do not control third parties' collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website, available at http://optout.networkadvertising.org/.


California Privacy Rights

California's "Shine the Light" law (Civil Code Section § 1798.83) potentially permits users of our Application that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact Us at http://www.blobbyfish.com/contact-us. We will examine your request and respond according to the requirements presented under the law.


CalOPPA Do-Not-Track Disclosure

Some browsers, applications, and operating systems have a ”do not track” setting that lets you tell websites and advertisers that you do not want to have your online activities tracked. At this time, We do not respond to ”do not track” settings or signals, but We do provide you the option to opt out of interest-based advertising as described immediately above.


Data Retention Policy, Managing Your Information

We will retain User Provided Information for as long as you use the Application and for a reasonable time thereafter. If you’d like Us to delete User Provided Information that you have provided via the Application, please contact Us at http://www.blobbyfish.com/contact-us and We will respond in a reasonable time. Please note that some or all of the User Provided Information may be required in order for the Application to function properly, and We may be required to retain certain information by law.


Information for Citizens of the European Union under GDPR

If you are a citizen of the European Union, you have rights as a data subject under GDPR. These rights are:

  • The right to be informed – this means We must inform you how We are going to use your personal data. We do this through this privacy policy.
  • The right of access – you have the right to access your personal data (e.g. data that is about you) that We hold. This is called a subject access request. However, as mentioned above, most of the data that We collect is anonymized in accordance with Recital 26 of the GDPR.
  • The right to object – you have the right to object to direct marketing from third parties We have shared your data with for direct marketing purposes. You can opt out of direct marketing any time by following the steps listed above in the Section titled “What are my opt-out rights for targeted advertisements?”.
  • Rights in relation to automated decision making and profiling – this is not something We do. If that ever changes, this policy will be updated accordingly.

Children

We do not use the Application to knowingly solicit data from or market to children under the age of 13, and We have taken reasonable steps to ensure that We do not solicit data or market to children under the age of 13. The Application is not designed for use by children under the age of 13. If a parent or guardian becomes aware that his or her child has provided Us with information without their consent, he or she should contact Us at http://www.blobbyfish.com/contact-us. We will delete such information from our files within a reasonable time.

Data Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information We process and maintain. For example, We limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although We do our best to protect your data, We cannot guarantee the security of your data transmitted through the Application. Any transmission of data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures We provide. 

Changes to this Privacy Policy

This Privacy Policy may be updated from time to time for any reason. The date the privacy policy was last revised is identified at the top of the page. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy at https://blobbyfish.com/privacy-policy. You are responsible for periodically visiting this privacy policy to check for any changes.

Your Consent

By using the Application, you are consenting to our processing of User Provided and Automatically Collection information as set forth in this Privacy Policy now and as amended by Us. "Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the U.S. your information will be transferred to the U.S., and processed and stored there under U.S. privacy standards. By using the Application and providing information to us, you consent to such transfer to, and processing in, the U.S.
